English law states that any charge a bank levies on its customers as a result of a breach of contract by the customer must be proportionate to the actual cost incurred by the bank as a result of that breach. This means that the current bank penalty charges are too high. Case law has highlighted the typical example of when a bank charges £20 for sending its customers a letter to state that they are overdrawn. Accordingly it cannot really cost the bank £20 to send such a letter. Sound familiar? You may have a claim!
